This focus area aims to understand and explore the manifestations of the digital transformation of the Indian (and other Global South) state(s). Indian law and policy has undergone a few different kinds of encounters with digital technologies in the last few decades. India’s entire welfare programme has moved to a digital platform, built around a digital identity that is becoming central to the recognition of a citizen. The adoption of newer technologies, largely through a series of administrative orders, rather than legislative exercises, has fundamentally changed the nature of citizen-state relationships and has also posed problems for traditional analog-era laws. This vertical will explore the many manifestations of the phenomenon of digital governance, the rendering of existing and inadequate regulations, and necessitating a need for regulatory evolution. The research may look at three kinds of encounters between law, policy, governance, and digital technologies— a) Accommodating Digital, which were mostly in context of ‘recognition’ of the digital and how law and policy needs to accommodate or address them; b) Responding to Digital, where the digital technologies being regulated play more than a functional role, and significantly change the way either activities are conducted, or how laws apply when faced with it; and c) Outdated by Digital, where emerging technologies which are mutative in nature and in a constant state of evolution, render traditional forms of regulation obsolete.
